The two frameworks for skilled nursing
Federal requirements at 42 CFR Part 483 apply to facilities that participate in Medicare or Medicaid. They are interpreted through the State Operations Manual, primarily Appendix PP, and enforced through the survey and certification process by state agencies acting on behalf of CMS.
State licensure rules apply because the facility operates in that state, independent of federal participation. They cover areas federal rules leave to states, and frequently set more specific requirements on staffing ratios, physical plant, administrator qualifications, incident reporting timelines, and medication administration.
Assisted living is a different regime entirely
Assisted living and residential care communities are generally not certified under 42 CFR Part 483 and are regulated at the state level. There is no single national standard, and terminology varies: assisted living facility, residential care facility, personal care home, adult care home, and board and care home may all describe comparable settings under different state rules.
The practical consequence is that guidance written for skilled nursing frequently does not transfer. An assisted living community researching a requirement needs its own state's rule, not Appendix PP.
Resolving a conflict between the two
When both frameworks address the same subject, the general rule is that the more stringent requirement controls. Federal participation requirements set a floor; a state may impose additional or stricter obligations, and meeting the federal minimum does not excuse a violation of the stricter state rule.
Compliance therefore means satisfying both simultaneously rather than choosing between them. Where a state rule appears to permit something federal rules prohibit, treat the federal prohibition as controlling for a certified facility and verify with the state agency before relying on the state reading.

- Check whether your state has adopted a stricter standard on the same topic
- Apply the more stringent of the two and document the basis for that determination
- Confirm the effective date — state rules change on their own legislative calendar, not the federal one
Why the citation you receive tells you which applies
A federal deficiency arrives as an F-tag tied to a CFR section and is enforced through federal remedies such as civil money penalties or denial of payment. A state licensure violation arrives under the state's own citation structure with state-specific consequences, which may include licensure conditions or state fines.
The same underlying event can generate both. Reading the tag on the statement of deficiencies is the fastest way to know which framework you are answering to and which corrective process governs your response.
